Dear Members & Pupils of the Selangor Bar,
The Selangor Bar recently held a meeting with the Chief Police Officer (CPO) of Selangor and officers from the Royal Malaysia Police (PDRM) to discuss several concerns raised by members regarding criminal investigations and related procedures.
The following matters were discussed during the meeting:
1.Recording of Caution Statements
Concerns were raised that clients/accused persons are allegedly not permitted to provide their own version of events in their caution statements, as the statements are purportedly pre-prepared by the Investigating Officer (IO). It was also highlighted that accused persons are allegedly discouraged from raising their defense on the basis that it would create an additional burden on the IO to investigate.
The Selangor Bar proposed that PDRM consider adopting a practice similar to that of the Malaysian Anti-Corruption Commission (MACC), whereby statements are recorded in a designated recording room.
PDRM took note of the matter and informed that appropriate action would be considered. Members are also encouraged to advise their clients of their legal rights during the statement-recording process.
2.Recommendation of Lawyers by Investigating Officers (IO)
Concerns were also raised regarding instances in which IOs allegedly insist that accused persons engage lawyers recommended by the IOs, despite the accused already being represented by lawyers of their own choice.
PDRM clarified that, should the suspect/accused inquire, they will suggest Yayasan Bantuan Guaman Kebangsaan (YBGK) or the Selangor Legal Aid Centre (SLAC) for accused persons requiring legal representation.
3.Traffic Investigation Reports (Keputusan Kemalangan)
Members highlighted complaints that traffic investigation reports are allegedly not provided unless payments ranging from RM500 to RM1,000 are made to the IO. It was proposed that such reports should instead be made readily available upon request at the counter.
PDRM has informed that members should lodge a report against any officer found requesting extra payments.
